These terms govern your use of the ListingShots website at listingshots.app and the ListingShots desktop application for Mac and Windows ("the app"). Both are operated by Viktor Braun, a sole trader based in Germany ("we", "us"). By downloading, installing, activating, or using the app, you accept these terms.

ListingShots is a desktop application that lets you design store listing assets (screenshots, feature graphics) for the App Store, Google Play, Microsoft Store, and similar platforms. The app runs locally on your machine. The website provides information, the download links, and access to the checkout.
When you complete a purchase, we grant you a non-exclusive, non-transferable, perpetual license to install and use the app on devices that you own or personally control. The license is granted to a single individual or, where the purchase was made by a company, to a single named user nominated by that company.
You may not:
Resell, sublicense, rent, lease, or distribute the app or your license code to a third party.
Share your license code publicly or with anyone outside your household or organisation.
Reverse engineer, decompile, or disassemble the app, except to the extent these activities are permitted by mandatory law.
Remove or alter copyright, trademark, or other notices in the app.
You keep all rights to the screenshots, graphics, text, and other content you create with the app ("Your Content"). We claim no licence in Your Content. You are responsible for ensuring that Your Content does not infringe the rights of others.
The app is sold as a one-time purchase. The current price, currency, and any applicable tax are shown at checkout before you confirm the order. There is no subscription. Once activated, your license remains valid for the major version you purchased; we may offer free updates within that major version at our discretion.
Payment is processed by Lemon Squeezy LLC, who acts as the merchant of record. The purchase contract is therefore concluded between you and Lemon Squeezy, who in turn passes the order details to us so we can deliver the license code. Lemon Squeezy's own terms apply to the payment transaction. Applicable VAT or sales tax is added at checkout where required.
After your payment is confirmed, your license code is emailed to the address you entered at checkout, typically within a few minutes. You can also re-download the installer from listingshots.app/download at any time at no charge. If you have not received your code within an hour, write to contact@listingshots.app with your order number.
Statutory right of withdrawal. If you are a consumer resident in the European Union, you have a right to withdraw from the purchase within 14 days of the contract date, without giving any reason (§§ 312g, 355 BGB).
Important — early loss of the withdrawal right for digital content. The app is digital content not supplied on a physical medium. Under § 356 Abs. 5 BGB, your withdrawal right ends as soon as we begin to deliver the digital content (i.e. once the license code is dispatched and you have started the download), provided that you have expressly consented to the immediate start of performance and acknowledged that you thereby lose your withdrawal right. By proceeding through checkout you give that consent. If you do not want to lose the withdrawal right, do not start the download and contact us within 14 days.
Goodwill refunds. Outside of the statutory right, we do not offer a guaranteed refund. If you run into a technical problem that we cannot resolve, write to us within 14 days of purchase and we will look at your case in good faith.
Statutory warranty rights for digital products under §§ 327 ff. BGB remain unaffected by this section.
We may release updates to the app to fix defects, improve security, or add features. Updates within the same major version are provided at no extra cost while we continue to maintain that version. We are not obliged to develop new features or to maintain the app indefinitely.
We provide the app with the statutory warranty for digital products under German law (§§ 327 ff. BGB). This means that the app must, on delivery and for the period required by law, conform to the agreed quality and be fit for the ordinary use of a store listing screenshot designer. If a defect appears within that period, contact us at contact@listingshots.app and we will work to fix it.
Beyond the statutory warranty, the app is provided "as is". We do not warrant that the app will meet your specific requirements, that exports will be accepted by any particular store or platform, or that operation will be uninterrupted or error-free.
We do not offer a service level agreement or uptime guarantee. The website and any ancillary online services (such as license activation and the download mirror) are provided on a "reasonable efforts" basis and may be unavailable for maintenance, upgrades, or reasons outside our control. The desktop app itself is local and continues to work offline once activated.
We are fully liable for damages caused by intent or gross negligence, for damages resulting from injury to life, body, or health, under the German Product Liability Act (ProdHaftG), and for any guarantee we have expressly given.
For damages caused by simple negligence, we are only liable for breach of a material contractual obligation — i.e. an obligation whose fulfilment is essential to the proper performance of the contract and on which you may reasonably rely. In such cases our liability is limited to the foreseeable damage typical for this kind of contract.
All further liability is excluded to the extent permitted by law.
The app and the website use or link to third-party services, including Lemon Squeezy (checkout), Openverse (Creative Commons image search inside the app), Wistia (demo video on the website), and Google Fonts (display font on the website). These services are operated by independent providers under their own terms and privacy policies. We are not responsible for the content or operation of those services. Our Privacy Policy describes how data flows to them.
You agree not to use the app or the website to: (a) violate applicable law, (b) infringe the intellectual property, privacy, or other rights of third parties, including by exporting screenshots that misrepresent third-party apps or brands, (c) transmit malware, or (d) attempt to gain unauthorised access to our systems.
The app itself has no age restriction. However, in Germany a minor (a person under 18) generally needs the consent of a parent or legal guardian to enter into a paid contract (§§ 106 ff. BGB). If you are under 18, please do not complete a purchase without your parent's or guardian's consent.
You may stop using the app at any time. We may terminate your license for cause if you materially breach these terms — in particular Section 3 (license restrictions) or Section 12 (acceptable use) — and do not cure the breach within a reasonable period after we ask you to. On termination for cause, your license code ceases to be valid and you must uninstall the app. Sections that by their nature should survive (license restrictions, liability, applicable law, dispute resolution) survive termination.
We may update these terms to reflect changes in the product or in the law. If a change materially affects your rights, we will give you reasonable advance notice (for example, by posting an updated version on the website with a new "Last updated" date). Continued use of the app after that date means you accept the updated terms. If you do not accept the change, you may stop using the app.
These terms are governed by the law of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with habitual residence in another country, you also benefit from the mandatory consumer protection provisions of the law of that country.
The exclusive place of jurisdiction for all disputes arising out of or in connection with these terms is, where permitted by law, the court competent for our place of business in Germany. For consumers, the statutory rules on jurisdiction apply.
The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
If any provision of these terms is held to be invalid or unenforceable, the remaining provisions remain in full force. We may transfer our rights and obligations under these terms to a successor in the event of a sale, reorganisation, or similar event; you may not transfer your license without our prior written consent.
